Abuse of law

Tax Glossary Definition

Abuse of law

Abuse of Law – A principle that permits tax authorities to ignore transactions that, although legally valid, have no genuine business purpose other than reducing tax liability. It enforces the “substance over form” approach, focusing on the real economic intent rather than the legal façade.

Example: Setting up shell entities purely to obtain tax reliefs can be regarded as an abuse of the law.
